Workplace Bullying

Workplace Bullying (Mobbing), Violence, and Harassment: The Complete Guide to Fighting Back

Workplace bullying (Mobbing) is not just “bad behavior” or a tough day at the office. It is a systematic process of moral harassment that undermines the employee’s dignity, mental health, and professional standing. At MRK Consulting , we know that the battle against Mobbing requires more than just advice. It requires evidence, legal shielding, and strategy. Acting as your personal
Confidential Counselor , we are here to turn fear into power.

The Legal Framework in Greece (Law 4808/2021)
The landscape in Greece has changed radically. Law 4808/2021, fully integrating the International Labour Organization (ILO) Convention 190, makes the prevention and management of all forms of violence and harassment mandatory, protecting every worker (including interns and job applicants).
What is the “Reversal of the Burden of Proof”?
This is your strongest weapon. If you provide evidence suggesting harassment has occurred, the employer is legally obligated to prove that NO violation took place . You do not need to prove their guilt with 100% certainty; they must prove their innocence.
Does this apply to the Public Sector?
Yes. There is full and equivalent provision for Civil Servants, detailed in the Government Gazette (FEK) B’ 343/26.01.2023 (“Prevention and handling of incidents of violence and harassment at work in Public Sector entities”).

The 7 Stages of Mobbing (MRK Consulting Research)
How do you know if what you are experiencing is Mobbing? The core characteristics are Duration and Escalation. Based on MRK Consulting’s research, these phenomena systematically manifest in the following order:
Verbal Violence:
Insults, sarcasm, yelling, and derogatory comments in front of others.
Passive Violence:
Deliberate failure to inform, withholding information, and “freezing out” the employee.
Psychological Violence:
Manipulation (Gaslighting) and constant questioning of abilities.
Sexual Harassment & Violence:
Unwanted comments, gestures, or actions.
Social Isolation:
Targeted exclusion from meetings and daily office communication.
Removal of Responsibilities:
Assigning pointless tasks or stripping away duties entirely to devalue the employee.
Spreading Rumors & Character Assassination:
Defamation and fabricated accusations.

Neurodiversity and Workplace Exclusion

Neurodivergent employees (individuals with ADHD, Autism , etc.) are often misunderstood due to different communication styles and are unfairly targeted. At MRK Consulting, we strategically specialize in neurodiversity , ensuring that your uniqueness is legally protected and never weaponized by a toxic work environment.

Frequently Asked Questions (FAQ) & Legal Guide

I

How can I prove mobbing? It requires strategy: keeping a “Violence Diary,” saving documents/emails, and obtaining medical assessments. As your Confidential Counselor, we draft the necessary Expert Opinion that legally fortifies your claim.

If I file a complaint, will I get fired? No. The law strictly prohibits retaliation. Any dismissal, demotion, or adverse change in working conditions as revenge is considered completely null and void.

What if HR ignores it or covers for the abuser? If the internal process fails, we take over the external escalation of your case to the Labor Inspectorate (SEPE) or the Ombudsman, ensuring the company assumes its legal responsibilities οr Internationally.

Can I secretly record the abuser? Secret recording is generally illegal in Greece. Courts only accept it as an exception if it is the absolute only means to protect your dignity. Always consult our legal network before taking such action.

Am I entitled to compensation? Yes. Victims can pursue significant financial compensation through the courts for moral damages, as well as coverage for medical expenses (e.g., therapy for workplace stress).

Why should I bother and not just let it go? Because with the Reversal of the Burden of Proof, the employer must act, or they risk heavy fines. Silence only feeds the abuser.

International Workers (Expats & Digital Nomads) in Greece

I

Are foreign workers protected from Mobbing in Greece? Absolutely. Law 4808/2021 protects all workers within Greek territory, regardless of nationality, contract type, or whether they work remotely (digital nomads).

Is my residence permit (Visa) at risk if I report my employer? No. The law provides strict protection against retaliation. Your employer cannot fire you for reporting harassment. Any such dismissal is void, meaning your employment-tied legal residency status remains secure.

Is there English-speaking support available? Legal and language barriers can make the situation terrifying. MRK Consulting acts as your English-speaking Confidential Counselor, guiding you through Greek labor law and helping you build a documented case before approaching Greek authorities.
